ARTS

On November 8, 2022, California voters approved Proposition 28: The Arts and Music in Schools (AMS) Funding Guarantee and Accountability Act, mandating the establishment of a new, ongoing program to support arts instruction in schools, effective from the 2023–24 academic year. This legislation designates 1 percent of the kindergarten through grade twelve (K–12) portion of Proposition 98 funding, excluding funds allocated for the AMS education program, for arts education initiatives. Local educational agencies (LEAs) with 500 or more students must ensure that at least 80 percent of AMS funds are used to employ certificated or classified employees for arts education instruction. The remaining funds can be allocated for training, supplies, materials, and arts educational partnership programs, with no more than 1 percent for administrative expenses. The complete text of the statute can be found in Chapter 5.1 of Part 6 of Division 1 of Title 1 of the Education Code (Sections 8820 et seq.).
